Asheville, NC -- A federal lawsuit alleging brutality against four Asheville city police officers has been settled out of court.

The Asheville Citizen-Times reports the city has agreed to pay Robert Dean Gaddy Jr. $70,000 in exchange for him dropping the complaint

City spokeswoman Dawa Hitch said under the settlement neither the city nor the officers admit any wrongdoing.

The 45-year-old Gaddy sued, saying police used excessive force when he was arrested for crimes of which he was later acquitted.

The lawsuit said he suffered a collapsed lung and other injuries when he was arrested in October of 2008. The case was to have gone to trial this week in U.S. District Court in Asheville.
