Winston-Salem, NC -- A lawsuit has been filed against a bar and the estate of the man involved in a deadly wreck with former State Rep. Larry Womble, D-Forsyth.

Attorney David Freedman filed the lawsuit in the Forsyth Superior Court for more than $10,000 in compensatory and punitive damages.

Womble is suing Sixth & Vine because the employees allegedly served David Allen Carmichael, 54, too much alcohol after he was clearly drunk.

A toxicology report revealed Carmichael had a blood alcohol content level of .29 when he died after crossing the center line in a head-on crash on Reynolds Park Road with Womble December 2, 2011.

As a result of the accident, Womble suffered from multiple broken bones and is blind in his left eye.

Police initially said Womble's car crossed the center line and hit Carmichael's car. He was charged in May with Misdemeanor Death by Vehicle. Those charges were dropped in November after the investigation showed witnesses were confused over whose car was heading in which direction, according to Womble's lawyer.

Womble told WFMY News 2 in November that he felt terrible for the Carmichael family and said he knows them well. "I still stand ready to do whatever I can to help them," he said. "Because they have to heal also."
