Murder Charge Dropped After Snow Globe Evidence Goes Missing

MORGANTON, N.C.-- A judge dropped a murder charge against a Burke County man accused of killing his stepfather because deputies couldn't find the snow globe the suspect said was thrown at him before the shooting.

The News Herald of Morganton reports the snow globe was found undisturbed in an evidence room two days after the murder charge against 28-year-old Timothy Bumgarner was dropped. But deputies say they don't plan to refile charges against Bumgarner at this time.

Bumgarner told deputies he shot his stepfather, 40-year-old Filiberto Rubio, because he feared for his life after Rubio threw a snow globe at him during a Thanksgiving Day 2010 fight.

Prosecutors didn't return phone calls from the newspaper. District Attorney-elect David Learner says he will review the case when he takes office in January.
