Can A Restaurant Refuse You Service? Yes and No

It just happened to a White House staffer. So, could it happen to you? And is it legal?

GREENSBORO, NC -- No shoes, no shirt, no service. Pay only with cash or pay only with credit.

You've heard these things before but service only if you're a democrat or republican? That's not usually something you see posted.

But even if it's not, it can happen...legally.

The most recent example, when White House Press Secretary Sarah Huckabee Sanders was refused service at The Red Hen.

It's legal for a business to do that. In fact, a business can refuse you for any reason they see fit.

The only protected reasons they can't turn you away are race, gender, national origin or religion.

Greensboro attorney Locke Clifford of Clifford, Clendenin & O’Hale, LLP explains it this way, “You can discriminate for good reasons, bad reasons or no reasons. Cause you’re the owner, even though it's a public place you can discriminate.”

An interesting side note, DC is one of the few places in the nation that has a law on the books that protects political affiliation.
